Lo Yee saw that the accused was in hot pursuit about a
couple of feet behind and Lo Yee jumped out and followed.
Presently he told us Wong Ka Yan collapsed and he, Lo Yee,
seized the accused man from behind. He had no idea at that
time that the accused was armed and pinned his arms to his
side and he then realized that the accused man was holding
a knife. He has said that all the way in that short pursuit
no blow was struck and he was eminently in a position to see.
He said no blow was struck nor could the accused man strike a
blow on Wong Ka Yan when he lay on the ground because his arms
were pinioned by Lo Yee. He has also told us that there was
blood on Wong Ka Yan when he ran and that he collapsed in a
pool of blood.
There is one other thing that Lo Yee has told us. He
said as he held the accused man before others led by Ha Kam Sirg
cine in and disarmed. the accused, the accused said to him "He
will die first and I will die afterwards." Ha Kam Sing
corroborates to this extent. He says "I took the knife from
the accused who was being held by Lo Yee and perhaps by some
others and Wong Ka Yan was lying in a pool of blood on the floor. The injuries he had sustained had been sustained
before I came along."
There is one other of the internee witnesses who is
important. We have heard a lot of them but they don't amount
to much, but there is one, Tse Tong, whose evidence is important because you will remember when he came in rather
late in the day, the deceased man was weltering in his blood on the ground there waiting for his wounds to be dressed and
the accused had gone to bed. He got into his bed and Tse Tong has told us he was lying there with a blanket pulled up
over him but Tse Tong was not having that: he went up to
him and said "Why have you done such a thing, cutting?"
clearly is an accusation, it cannot to reasonable men mean
anything else. "Why have you done such a thing, cutting"?
